CLIENT AGREEMENT, RELEASE, & WAIVER OF LIABILITY

           Ghost Baby Fitness, LLC, offers individualized and group fitness classes online and in person, that involves instruction related to physical fitness and conditioning and may include the use of exercise equipment (the “Program”). In consideration of my participation in the Program, I understand, acknowledge, and hereby agree to the following:

I understand that my participation in the Program will require physical exertion and stretching and that there are risks due to the strenuous and rigorous nature of the exercises. These risks may include, but are not limited to, abnormal blood pressure, fainting, heart attack, muscle strain, broken bones, disability, or possibly death. I understand that the use of exercise equipment also carries a risk of injury, including disability and death. While rules and techniques may minimize the risk of such injury, I understand that serious risk remains, and I am knowingly and voluntarily assuming full and sole responsibility for all risks, injuries, and damages that I may incur. I agree to listen to my body and monitor myself during every class session.

I understand that it is my responsibility to consult a physician prior to and regarding my participation in the Program. I represent and warrant that I am suffering from no condition, impairment, disease, infirmity, or other illness that would prevent my participation in the Program or the use of any equipment with Ghost Baby Fitness, LLC. I have and will continue to keep Ghost Baby Fitness, LLC fully informed of any condition that would limit my participation in the Program and I will promptly notify Ghost Baby Fitness, LLC of any material change to my health or physical condition, including pregnancy.

My participation in the Program is completely voluntary. I assume full and sole responsibility for my health and safety and for all risks, injuries, or damages that I may incur participating in the Program.

I understand and accept that to properly teach and correct therapeutic movement, physical contact between my instructor and myself may be necessary. I consent to such contact and recognize that my instructor will apply any necessary contact in a professional manner. I agree to inform my instructor of any types of contact to which I do not consent before or as soon as they arise.

On behalf of myself, my heirs, and legal representatives, I hereby knowingly, voluntarily, and expressly waive, release, discharge, covenant not to sue, and agree to indemnify, defend, and hold harmless Ghost Baby Fitness, LLC and its officers, agents, employees, contract employees, representatives, and all other persons or entities acting on behalf of Ghost Baby Fitness, LLC from and against any and all claims, liabilities, damages, losses, demands, causes of action, and costs and expenses, including but not limited to attorneys’ fees and court costs, whether known or unknown, directly or indirectly arising out of or relating to my participation in the Class, including but not limited to claims of physical or psychological illness or injury, bodily harm, medical expenses, death, damage to property, and loss or theft of personal property, regardless of whether such claims arise in whole or in part from the acts, omissions, or negligence of the parties.

The benefits of the Program can be many, including enhanced cardiovascular functioning and muscle tone and development, stronger bone density, and enhanced body image and mood. However, I understand and acknowledge that Ghost Baby Fitness, LLC makes no warranty or guarantee, whether express or implied, as to any specific outcome from the Program.  

I hereby understand that the Ghost Baby Fitness, LLC from time to time may photograph, video, or otherwise record classes and place such photographs and videos on its Website or Social Media platform. I hereby consent to the use of my image that may appear in any such photograph or video.

All claims arising out of or related to this agreement will be governed by California law excluding such State’s conflict of laws rules and will be litigated exclusively in Los Angeles County unless agreed otherwise by both parties in writing. To the extent any provision of this Agreement is held unlawful, void, or for any reason unenforceable, such provision shall be deemed severable from this document and shall not affect the validity or enforceability of the remaining provisions.

Ghost Baby Fitness, LLC, does not own the rights to the music played during classes

 

I AFFIRM THAT I AM AT LEAST 18 YEARS OLD AND THAT I HAVE READ AND UNDERSTAND THE ENTIRE ABOVE AGREEMENT, AND I AM SIGNING IT FREELY AND VOLUNTARILY.
